Terms of Use

ShortTab is a marketplace and discovery platform that lets local restaurants and bars ("Businesses") post live deals, and lets consumers ("Consumers") browse, save, and review those deals. Consumers can also submit deals they've spotted at a Business, including Businesses that don't yet have a ShortTab account — submitted deals are marked unverified until the Business or another user confirms them.

• You must be able to form a binding contract to create an account, and must provide accurate, current information.
• There are two account types — consumer and business — and the Service is built around keeping them separate; you agree to sign up for, and use, the account type that matches you.
• Business accounts must be created using an email address on the business's own domain, not a personal email provider, and represent that you're authorized to act on behalf of that business.
• You're responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
• We may suspend or terminate accounts that violate these Terms, provide false information, or are used fraudulently or abusively — see Section 9.

ShortTab is a venue for Businesses to advertise their own deals — we are not the seller, and we're not a party to any transaction between you and a Business. Availability, pricing, redemption, quality, and fulfillment of any deal are the sole responsibility of the Business offering it. ShortTab doesn't process payments for deals, doesn't guarantee a deal is still available or accurate, and isn't responsible for a Business's failure to honor a deal. Disputes about a deal itself should be resolved directly with the Business.

"User Content" means anything you submit to the Service — reviews, ratings, deal submissions, photos, business profile content, and similar. You retain ownership of your User Content, but you grant ShortTab a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and distribute it as part of operating and promoting the Service (for example, showing your review on a deal's page).

You're solely responsible for your User Content and confirm you have the rights to post it. Reviews should reflect your own honest, firsthand experience. Deal submissions should be accurate to the best of your knowledge — remember that unverified submissions are shown as such until confirmed. We may remove or refuse to display User Content that violates these Terms, at our discretion, though we're not obligated to monitor all content.

You agree not to:

• Post false, misleading, defamatory, or fraudulent content, including fake reviews or fabricated deals.
• Impersonate any person or business, or misrepresent your affiliation with one.
• Use the Service for any unlawful purpose, or in a way that infringes anyone's intellectual property or other rights.
• Attempt to access another user's account, interfere with the Service's operation or security, or scrape or harvest data beyond normal use.
• Use the Service to send unsolicited advertising or spam to other users.
• Circumvent any content moderation, account suspension, or ban.
• Post or transmit any sexually explicit, obscene, or adult content.
• Engage in any activity that exploits, harms, or threatens minors, including child sexual abuse material (CSAM) or child grooming.
• Promote, facilitate, or encourage hate speech, harassment, bullying, or violence against individuals or groups.
• Share or promote illegal drugs, regulated substances, weapons, or other unlawful goods and services.

If you use a Business account, you additionally represent that any deal you post is accurate, that you're authorized to offer it, and that you'll honor it on the terms stated for however long it's live on the Service. You're responsible for complying with applicable law governing your promotions, advertising, and any SMS program you configure (see Section 7). Some Business features described in the Service (such as paid deal-boosting) may not be active yet and will be subject to separate terms if and when they launch.

If a Business configures a Tap2Join number and keyword, tapping it opens a text message from the Consumer's own device directly to that Business's number — ShortTab doesn't send, receive, or store that message. Any resulting SMS opt-in, consent, message/data-rate disclosure, or opt-out process is solely between the Consumer and the Business under the Business's own program, and the Business is solely responsible for that program's compliance with applicable law (including telemarketing/SMS consent laws).

The Service, including its design, text, graphics, logos, and the ShortTab™ name and marks, is owned by ShortTab or its licensors and protected by intellectual property law. Except for your own User Content, you may not copy, modify, distribute, or create derivative works from the Service without our permission.

We may suspend or terminate your access to the Service, with or without notice, if we believe you've violated these Terms, provided false information, or engaged in conduct harmful to ShortTab, other users, or Businesses. You may stop using the Service and request deletion of your account at any time (see the Privacy Policy).

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DON'T WARRANT THAT ANY DEAL, LISTING, OR PIECE OF USER CONTENT IS ACCURATE, COMPLETE, OR CURRENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

TO THE FULLEST EXTENT PERMITTED BY LAW, SHORTTAB WON'T BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE OR ANY DEAL, BUSINESS, OR OTHER USER YOU INTERACT WITH THROUGH IT — EVEN IF WE'VE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

You agree to indemnify and hold ShortTab harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service, your User Content, or your violation of these Terms.

These Terms are governed by the laws of the state or country in which ShortTab is organized, without regard to its conflict-of-laws principles, and any dispute arising from these Terms or the Service will be resolved exclusively in the state or federal courts located there.

We may update these Terms from time to time. If we make material changes, we'll update the "Last updated" date above and, where appropriate, provide additional notice. Continuing to use the Service after a change takes effect means you accept the updated Terms.
